General conditions of sale

Sales made on the site www.mymarketma are exclusively reserved for individuals and legal entities with an email address and a delivery address located in one of the areas served by My Market. To find out if the desired delivery location is part of the areas served by My Market, please enter the postal code of the desired delivery location in the area provided for this purpose on the registration page.
No delivery or after-sales service will be carried out outside this territory. These general conditions of sale and the specific conditions of sale specific to each of the items offered on the site govern only the relations between the company RIZKOUNER sarl E-Commerce Maroc and its customers, to the exclusion of any other condition.
1. ACCEPTANCE OF CONDITIONS
Any confirmation by the customer of an order entered on the site www.mymarket.ma (hereinafter the Site) implies on his part the acceptance of these general conditions of sale RIZKOUNER Sarl, subject to Moroccan law and the acceptance of the specific conditions of his order (items ordered as presented on the site within the limit of the quantities mentioned). As such, no order can be sent without the customer having previously and expressly indicated, by checking the box provided for this purpose, that he has read and accepts these general and specific conditions of sale. Finally, it is specified here that the customer has, before this confirmation, a mechanism allowing him to correct or modify his choices. This mechanism is accessible at each stage of the order entry process.
2. PRODUCTS
2.1 Offer of products and services
The list and characteristics of the products offered on MYMARKET.MA are subject to change and adaptation at any time to better meet the customer's expectations. The products and services offered on MyMarket.ma comply with Moroccan legislation and the standards applicable in Morocco.
To ensure the availability of products sold by MyMarket.ma ( Rizkouner SARL ) to its customers, particularly during promotional offers, MyMarket.ma ( Rizkouner SARL ) reserves the right to refuse to honor all or part of an order deemed abnormal with regard to the quantities of products usually ordered by a consumer.
2.2 Availability of products
The products and services are available at the prices and conditions offered as long as they are visible on the Myarket.ma website (within the limits of available stocks). The information relating to the availability of the products comes directly from our suppliers and RIZKOUNER sarl service providers and may exceptionally be incorrect or imprecise. MyMarket.ma undertakes, in this case, to provide the customer with any additional details necessary for the smooth running of their order. As soon as their order is validated, MyMarket.ma confirms to the customer the availability of the products ordered. In the exceptional event that the information relating to the availability of the products is incorrect, MyMarket.ma undertakes to inform the customer by email or telephone and to provide them with any additional details necessary for the smooth running of their order.
3. USER NAME AND PASSWORD
When placing an initial order, and in order to personalize each customer's environment, a username and password are chosen and entered by the customer. The system then checks the uniqueness of the identifier. The username and password constitute proof of the customer's identity and bind the customer to any order placed through them.
The customer is solely responsible for his username and password. He will bear the consequences that could result from any use by third parties who have become aware of them, unless he demonstrates that knowledge of his username and password results from a fault MyMarket.ma
If you forget your password or username or if you fear that a third party may have learned of it, the customer has a function on the site that allows you to find your username and choose a new password. The system then automatically deletes any bank details that may have been saved during a previous order. MyMarket.ma complies with In accordance with Law 09-08 of 18 June 2009 on the protection of individuals with regard to the processing of personal data, you have the right to access, rectify or delete data concerning you.
4. FORMATION OF THE CONTRACT: METHOD OF OPERATION AND PROOF
4.1 Registration, sending or withdrawal of the order
An order placed on the MyMarket.ma website is not limited on the one hand by a minimum total amount (cost of goods including tax, excluding service charges), on the other hand by maximum quantities. Any order entry is simultaneously the subject of a summary before the customer is invited to confirm his order by indicating his choices as to the date, the time slot (subject to availability), the delivery address and the means of payment. The customer then has the possibility to rectify or complete his order. The customer is then invited to "validate and pay"; this order confirmation by double click constitutes firm and final validation subject to the reservation referred to in the following paragraph. Any order with the choice of payment by bank card or payment card is only considered effective when the payment centers concerned have given their agreement. In the event of refusal by said centers, the order is automatically canceled and the customer notified by a message on the screen.
4.2 Confirmation of receipt of the order by MyMarket.ma, preparation of the order and formation of the contract
MyMarket.ma confirms to the customer the receipt of his order. This confirmation is communicated to the customer by email summarizing the products ordered, the date and time slot of delivery, the chosen payment method (Payment on delivery, online by credit card, or by check on delivery) and indicating an order number. All prices mentioned in this letter include VAT. The possible unavailability of certain items on this date does not affect the order of other products. The customer is informed by email (electronic mail) of any unavailable items and their price is obviously deducted from the total price of the order entered by the customer.
MyMarket.ma reserves the right not to accept an order, for a legitimate reason, for example due to a difficulty in supplying a product, a problem concerning the understanding of the order received (illegible document, etc.), a foreseeable problem concerning the delivery to be made (example: delivery requested in a geographical area where there are proven risks of aggression or verbal or physical threats against our delivery drivers or damage to our delivery trucks) or due to the abnormality of the order placed on our website. In particular, any new order from a customer with whom there is, on the day of the order, an ongoing dispute relating to the payment of a previous order or any order mentioning a delivery address that turns out to be inconsistent or any order exceeding the usual needs of a consumer and likely to make delivery to our other customers impossible will be considered abnormal.
In the event that an order cannot be accepted for one of the above reasons, MyMarket.ma will inform the customer by email. In particular, the customer is asked to regularly check their email inbox to be aware of any message that may be sent to them by MyMarket.ma concerning the invalidity of their order or the impossibility of proceeding with delivery.
The sales contract is complete at the time of confirmation of the order by double-clicking. The order is then confirmed to the customer by sending a confirmation email. The transfer of risks to the customer occurs at the time of home delivery or collection of the order at a collection point if the customer has opted for this delivery method. The information provided by the customer when placing the order is binding on the customer: in the event of an error by the customer in the wording of their contact details or those of the place of delivery, in particular their surname, first name, address, telephone number, email address or bank or payment card number, resulting in the loss of the products, the customer remains responsible for payment of the lost products.
4.3 Proof
MyMarket.mat's automatic recording systems are considered to be proof of the nature, content and date of the customer's order and the nature, content and date of the confirmation of receipt of the order by MyMarket.ma and the nature, content and date of any email exchanged between My Market.ma and the customer. Information relating to any transaction carried out using the identifier will be stored and archived by My Market in compliance with current Moroccan legislation and will serve as proof in the event of a dispute with the customer. They will have probative force in the event of a dispute between the parties and will be kept by MyMarket.ma for the period of limitation under common law.
5. PROMOTIONAL CODES - DLC - FREE SHIPPING OFFERS
Promotional offers usable on the site are subject to conditions:
- Promotional offers are accessible via a promotional code that you simply need to enter for each order on the "summary basket" page to benefit from them.
- They are limited to one offer per household (same name, same postal address). Promotional offers can be deducted from the original price, or free products. Promotions on products with a close DLC, it is sung on each product in the section PROMOTIONS , they are subject to NO RETURN or exchange, and not refundable except for a hidden defect.
6. DELIVERY
6.1. Delivery terms
Delivery is carried out by MyMarket.ma delivery men or service providers in Morocco within the limits of the delivery areas served by MyMarket.ma . The place and date of provision of the goods are chosen by the customer according to the different time slots offered when ordering by My Market ma. The customer agrees to take charge of the goods upon their arrival:
- AT HIS HOME (according to the address provided by him when entering his order), at the times and days agreed with MyMarket.ma when ordering. The customer agrees to provide proof of his identity by one or more official documents in force and by communicating the number that was assigned by the system to his order and which was communicated to him in the order confirmation email by MyMarket.ma. Delivery is made to the door of his home.
- AT THE HOME OF A THIRD PARTY OF HIS CHOICE at the times and days agreed with MyMarket.ma when ordering. In this case, the third party must also agree to provide proof of his identity by one or more valid identity documents and to communicate the number that was assigned to the order by the system and which was communicated to the customer in the order confirmation email by MyMarket.ma. Delivery is made to the door of his home.
- AT A COLLECTION POINT from the date on which the customer was informed of the availability of his order at a collection point. When collecting the order, the customer agrees to provide proof of his identity by providing one or more official identity documents in force and to communicate the number that was assigned to the order by the system and communicated to the customer in the order confirmation email. As soon as they are collected, the products belong to the customer and are therefore under his responsibility.
6.2. Receipt of the order
Upon delivery, the customer is required to check the condition of the package. In the event of non-conformity upon delivery, the customer must make reservations on the delivery note or refuse the goods. Upon home delivery or collection in store, the customer can check the conformity of the products ordered by unpacking them. The conformity of the order is understood as the presence of the products, their suitability in relation to the order and their apparent condition.
The customer also agrees to sign the receipt presented by the delivery person representing MyMarket.ma or the reception staff at the collection point or to authorize the third party receiving the goods to sign this receipt, on which any comments that may appear necessary on the status of the order or the number of items delivered may be noted. Signing the receipt and indicating the number of packages received constitutes acknowledgement of delivery.
In the event that the customer notices, after opening the packages, damaged or missing products, it is their responsibility to contact Customer Service within three (3) working days to obtain the exchange or reimbursement of the products, subject to the return of the products to MyMarket.ma.
If MyMarket.ma is unable to deliver, the customer will be informed as soon as possible by any means such as emails (electronic mail) or telephone. MyMarket.ma also undertakes in this case to reimburse the delivery costs as compensation, except in cases of force majeure. Similarly, if the customer is unable to take charge of the products at the time agreed for delivery (day and time slot), it is their responsibility to inform MyMarket.ma as soon as possible by any means such as emails (electronic mail) or telephone.
Unless waived by MyMarket.ma , delivery costs remain the responsibility of the customer in this case.
6.3. Delivery costs
Delivery costs are the responsibility of the customer, except in special cases where MyMarket.ma takes charge. Delivery services are billed according to the scale below. The exact amount is specified before the order is validated.

6.4. Delivery times:
The delivery time can vary from 24 hours to 20 working days depending on the product(s) ordered. A paid order cannot be cancelled, no withdrawal can be the subject of this order, if the customer decides to abandon his order, the fresh products will be automatically destroyed.
Shipping address: Mymarket may put your order on hold if your address when you make your purchase is incomplete or incorrect. Fresh products will be destroyed for food hygiene reasons and will be at your expense when sending the order.

MyMarket.ma reserves the right to block a customer if it is a fraudulent act or repeated cancellation.
Goods that are rapidly perishable or likely to deteriorate quickly (opened drinks);7. WITHDRAWAL
7.1 Withdrawal period
In accordance with legal provisions, the withdrawal period only applies in favor of a consumer customer. The consumer has a period of 7 (seven) clear days from the withdrawal of the product or the delivery of the product to his home to exercise his right of withdrawal or from taking possession of the last batch or when the order is made up of several batches or goods.
7.2 Exclusions from the right of withdrawal
The following cannot be subject to a right of withdrawal:
- Services fully performed if the consumer has given his express prior consent to their execution, and acknowledged that he would lose his right of withdrawal after execution of the contract;
- Goods specially manufactured or personalized at the request of the consumer;
- Sealed goods that cannot be returned for health or hygiene reasons and which have been unsealed by the consumer after delivery (food, maintenance, hygiene, etc.)
- Sealed audio or video recordings or software, unsealed after delivery;
- Digital content not supplied on a tangible medium if performance has begun with the consumer's express prior consent;
- And more generally any good due to its nature which after being delivered is no longer identifiable because it has become inseparably mixed with other products.
- Products on sale and clearance: Groceries, household appliances, electronics, hygiene, etc. are not subject to cancellation/refund or exchange (in the event of hidden costs or deterioration of the product, a supplier guarantee is provided to you and you can benefit from it).
- In the event that the customer is not available, refuses the order or does not show up the same day to collect their order (drive for example), fresh products cannot be refunded: Fruits, vegetables, dairy products, dairy products, fish, meats, etc. Also, delivery costs will not be refunded.
- A Product in perfect condition but used repeatedly cannot be subject to withdrawal.
7.3 Terms of withdrawal
To withdraw, the customer can:

In all cases, the withdrawal document must include at least the customer's first and last names, as well as their order number and invoice.

7.4 Conditions and terms of return
In accordance with current regulations, "the consumer returns or restores the goods to the professional or to a person designated by the latter, without undue delay and, at the latest, within seven (7) days following the communication of his decision to withdraw in accordance with Article L. 121-21-2, unless the professional offers to recover these goods himself." The product must be returned by the customer, #### at his expense (unless he opts for free return via the carrier MyMarket.ma - recommended to avoid theft and loss)#### , in its original condition and complete (accessories, instructions, etc.) obligatorily accompanied by the purchase invoice, to the address indicated on the return slip. In accordance with Article L.121-21-3 of the French Consumer Code, "the consumer's liability may only be incurred in the event of depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of these goods". Items returned incomplete, damaged, damaged, having been in contact with dangerous chemicals, or in such a dirty state that they are unsaleable because they have been depreciated will be returned to the customer; their liability may, where applicable, be incurred. The original packaging must be carefully protected to avoid any deterioration by being packed and wedged in sturdy and suitable boxes. Similarly, any service provided on behalf of the customer, and with their agreement, before the expiry of the period of seven (7) clear days will not give rise to a refund. The customer is responsible for the proper delivery of the products and in particular for the ad valorem insurance of these products.
7.5 Reimbursement terms
In the event that the customer exercises the right of withdrawal in accordance with the applicable regulations, MyMarket.ma undertakes to reimburse the customer within (20) twenty days from the first of the following dates:
- receipt of the property in its entirety,
- receipt of proof of shipment of the entire good (mentioning the sender, the recipient and the product shipped).
The refund is made using the same payment method as that used by the customer, unless otherwise requested by the customer (request for a credit note). In the event of an option for a credit note, it cannot be refunded for its cash value, and will be valid for one year from its issue. In the event of partial use of the credit note, the remainder will remain available to the customer under the same conditions as the original credit note. The customer is informed that the refund of the costs related to the initial delivery will be made in proportion to the weight of the returned items. Thus, if the customer returns all of the goods in their order, they will be refunded for the entire initial delivery costs. If, when ordering, the Customer benefited from a promotional advantage, they will be refunded the price they actually paid or that should have been paid if they no longer meet the conditions to benefit from it. Similarly, in the event of exercising the right of withdrawal on a product having benefited from a loyalty advantage credited to the loyalty program, the advantages granted will be immediately debited from said loyalty account.
8. PRICES
All orders (products and services) are payable in MAD (Moroccan dirhams). The prices of products and services are subject to fluctuations and are updated daily. The prices charged are those in effect on the day the order is validated. They appear on the product and service presentation sheets and on the order summary. The prices indicated on the product lists and on the sheets entitled "detailed information" do not include delivery costs. Delivery costs are indicated on the site, during the order summary, before the customer validates the latter by double-clicking. The total price including tax indicated in the confirmation of receipt of the order is the total price of the order entered, expressed including all taxes and including VAT. The prices visible on the Site are only valid for online purchases.
9. Processing your order
9.1 Information when ordering
The customer is responsible for the completeness and conformity of the information (delivery address, collection point, bank details, delivery constraints, etc.) validated when ordering.
9.2 Tracking your order
By consulting the Site, the customer can follow the status of his order from its validation and for a period of one (1) year. He can also have access, upon simple request to the customer service of MyMarket.ma , to the details of his orders for a period of 10 years from the placing of these orders.
10. Payment terms
10.1 Cash payment methods
To pay for his order online, the customer has all the payment methods offered during the final validation of his order. Bank card: Visa card, Mastercard and e-bank card, Paypal, payment and bank transfer are accepted on the Site. The customer explicitly acknowledges having the rights to use the payment method he has selected. When paying in full online, the amount of the order actually delivered will be debited at the time of delivery.
10.2 Payment of an order by check
Payment by check is available for all orders. The check must be issued by a bank domiciled in Morocco.
In the event that he chooses to pay by check, he makes it payable to MyMarket.ma and then hands over the check upon delivery, accompanying it with the presentation of one or more identity documents.
In the absence of authorization for payment by bank card or payment card or payment by check, the order is not made available to the customer.
MyMarket.ma participates in the fight against payment fraud (checks and bank cards) and unpaid bills, consulting its partners if necessary (see details in paragraph 13).
MyMarket.ma therefore retains ownership of the items delivered in any event until full payment of the price by the customer and reserves the right not to follow up or to impose certain types of payment on the order of a customer who is the subject of an unresolved unpaid amount or whose means of payment present anomalies.
10.3 Security of online payments / Data transmission
MyMarket.ma is committed to the security of online payments. The transmission of payment data is encrypted, from the moment it is entered. It is impossible to read them during their single transfer via the Internet. The only information then circulating on the MyMarket.ma site, during orders, is a coded number associated with the payment card which in no way allows the real card number to be found.
11. GUARANTEE Bank card payment
To pay for your order by credit card, you choose the payment method from those offered by www.mymarket.ma on the Order Form (Visa, MasterCard, Maestro, cmi, Maestro, Diners Club and Discover).
In this case, the transaction will be debited from your account within the day (subject to availability of products from our suppliers) following the date of delivery confirmation.
The Consumer guarantees to the Company RIZKOUNER sarl that he has the authorizations possibly necessary to use the payment method chosen by him, when validating the Order Form.
In the event of payment by bank card, the provisions relating to fraudulent use of the means of payment provided for in the agreements concluded between the Consumer and the issuer of the card between the Company mymarket Ma SARL and its banking establishment apply.
In the event of a stock shortage, the amount of the cancelled item(s) will either be deducted from the total amount debited or credited back to the account within 3 working days after the amount including the cancelled item(s) has been debited, or a voucher valid for 1 year on all our MyMarket.ma items.
PAYMENT SECURITY
The electronic payment security system implemented by Payzone is certified by the Interbank Monetics Center (CMI) and by Moroccan Banks as well as by the international organizations VISA and MasterCard.
The Payzone system ( www.payzone.ma ) guarantees the confidentiality of your banking data because it is based on the encryption of exchanged information and is based on standard technologies and concepts recognized and proven on the Internet. In addition, your banking data is transmitted directly to the Interbank Payment Center (The CMI).
The CMI handles financial transactions between your bank account and our site's account.
To be able to pay by credit card online, you must provide the type of your payment card (cmi, VISA, MASTERCARD,), the payment card number, the expiration date and the CVV code. You guarantee that you are fully authorized to use the said card.
12. SUSPENSION OF THE VALIDITY OF A CUSTOMER’S IDENTIFIER
In the event of non-payment of the amounts owed by a customer, MyMarket.ma may automatically and immediately suspend the validity of the customer identifier.
13. CUSTOMER RELATIONS SERVICE

15. LOYALTY POINTS
15. PERSONAL DATA
15.1 Collection of personal data
In order to ensure the processing, monitoring and archiving of orders, MyMarket.ma must necessarily process and collect personal data concerning the customer. This data may be transmitted to service providers located outside Morocco. When this is the case, these transfers are processed according to the recommendations of the European Commission.
The data processed by Google, Yahoo, and Facebook are transferred to the USA, for the following purposes: personalization of your preferences, advertising and management of social networks.
The data is processed by MyMarket.ma, and where applicable the service providers and/or partners concerned, according to the methods and for the following purposes:
15.1.1 Order management
The provision of personal data collected for the purposes of distance selling is mandatory for the confirmation and validation of the customer's order as well as its tracking and shipping; in their absence, the customer's order cannot be processed: these mandatory data are identified by an asterisk on the form that is completed when ordering, the others are optional. These data may be transmitted to MyMarket.ma service providers :

for the sole purpose of the proper execution of the order and in particular its delivery, according to the options selected by the customer when ordering (e.g.: collection location); where applicable, they may be checked upon delivery;

the establishment of statistics.
15.1.2 Fight against fraud
MyMarket.ma reserves the right not to follow up on the order of a customer for whom problems (fraud or non-payment) have already occurred. MyMarket.ma retains in any event ownership of the items delivered until full payment of the price by the customer. The information relating to your order is subject to automated data processing which has the purpose of determining a level of risk of fraud for each transaction, under the responsibility of MyMarket.ma
In order to strengthen the level of security and protection against possible identity theft or attempted fraud, the data collected by MyMarket.ma from its customers as part of an order are used for analysis and assessment of a level of trust related to each order. The occurrence of an unpaid amount due to fraudulent use of a means of payment will result in the registration of the contact details relating to your order associated with this unpaid amount in a payment incident file implemented by MyMarket.ma. An irregular declaration or an anomaly may also be subject to specific processing. In addition, MyMarket.ma may retain the data for the purposes of enriching and managing its order analysis system. In accordance with Law 09-08 of June 18, 2009 relating to the protection of individuals with regard to the processing of personal data, you have the right to access, rectify or delete data concerning you MyMarket.ma in its capacity as data controller, at the following address support@mymarket.ma
15.1.3 Fight against unpaid checks
Payment by check is accepted subject to verification with the national file of irregular checks of the Bank of Morocco, and uses automated processing using information relating to the customer's order. MyMarket.ma may possibly contact your bank to find out your solvency.
Consequences of fraud and non-payment
When the control of a payment or an order reveals an unpaid amount, fraud or attempted fraud, the Customer may be entered into a file listing fraud and unpaid amounts until the situation is regularized. Under these conditions, MyMarket.ma may refuse to honor the orders of customers listed in this file until the situation is regularized. In all cases, the customers concerned will be informed individually.
In the event of a risk of fraud being detected, MyMarket.ma reserves the right to carry out a counter-check or to cancel the order to guarantee the security of online transactions.
15.2 COOKIES

17. LIABILITY AND FORCE MAJEURE
17.1 Liability
MyMarket.ma certifies that all products marketed on the Site comply with current Moroccan legislation. MyMarket.ma cannot be held liable in the event of misuse of the products ordered or any suspension of the service, regardless of its duration. MyMarket.ma cannot be held liable for any inconvenience or damage inherent in the use of the Internet, including a service outage, external intrusion or the presence of a computer virus or any other case of force majeure or fortuitous event. MyMarket.ma reminds that only minor children authorized to hold a means of payment under parental agreement have the possibility of ordering products on the Site and can make purchases relating to everyday activities.
17.2 Force Majeure
Force majeure events as defined by Moroccan legislation and case law that make it absolutely impossible for RIZKOUNER sarl to perform the sales contract under the conditions provided for constitute a cause for suspension or termination of RIZKOUNER sarl's obligations, if the event continues beyond a period of 1 month. MyMarket.ma cannot then be held responsible for the non-performance of the contract concluded in the event of the occurrence of one of the events mentioned above.
MyMarket.ma will be released from the scheduled delivery, in the event of the occurrence of a force majeure event and in particular if it is prevented, limited or disrupted due to a fire, explosion, failure of transmission networks, impossibility of supply, collapse of installations, epidemic, earthquake, flood, ice, snow, power failure, war, embargo, law, injunction, request or requirement of any government, strike, boycott or any other circumstance beyond the reasonable control of MyMarket.ma or likely to make the execution of this delivery exorbitant, as well as any unforeseeable, irresistible event whose occurrence is outside the will of the parties. In this case, MyMarket.ma informs the customer by email or any other means of the impossibility of the scheduled delivery due to the force majeure and the forecasts for restoring the service. Similarly, the customer will be discharged from receiving the expected delivery, subject to the most prompt notification possible to MyMarket.ma , for any case of force majeure usually recognized by the courts. If the force majeure event continues beyond one month from its occurrence, the Parties may notify each other by registered letter with acknowledgment of receipt, the cancellation of the order without the right to compensation on either side.
18. MODIFICATION
MyMarket.ma reserves the right to adapt or modify these general terms and conditions of sale at any time. We thank you for consulting them regularly. The applicable general terms and conditions of sale are those in force on the day of your order. With each new order, MyMarket.ma invites the customer to carefully reread the general terms and conditions of sale in force.
19. ENTIRETY
The invalidity of one of the clauses herein, in particular pursuant to a law, a regulation or following a decision of a competent court which has become res judicata, will not result in the invalidity of the other clauses of the general conditions of sale.
20. DISPUTES

In the absence of an amicable agreement between the Parties at the end of one of these procedures, the dispute will be submitted to the Moroccan courts of Casablanca; the competent court will be that of the defendant.
